The Terms & Variation
By using this service you acknowledge that the terms & conditions may be varied from time to time. Notice of the variation will be by way of electronic notice on the website and will be binding on you.
Payment for Service
Payment is by credit card payment, electronic funds transfer or cheque and the service will be provided once the card or electronic transfer is advised as debited by our service provider and credited to our account or if paying by cheque upon clearance of the cheque (allow 3-7 days for clearance).
All transactions are processed in Australian Dollars (AUD).
Please choose carefully. Please ensure you have the correct property address. Once the search request has been processed no refund will be available.
If you cancel the Form 1 preparation before it has been completed no preparation fee will be charged. If this has been debited a refund will be made available within fourteen (14) days of cancellation of the order.
Delivery of the Form 1
Delivery of the Form 1 will be completed within 1 - 2 business days of obtaining all property searches and will be available in PDF format for you to download from our website, sign and serve.
We are not responsible for any reasonable delay in delivery however caused.
Responsibility, Liability & Warranty
We bear no liability or responsibility for any changes you make to the Form 1 documentation once received from us. The Form 1 preparation is subject to us receiving full searches for your property and the completed signed Vendor questionnaire with any additional information you may have in relation to the property. This form can be downloaded from our website or completed and submitted via our website.
We can only complete the Form 1 with the information provided and give no warranty as to its accuracy. As the Vendor you must check the form to ensure it is correct before you sign it. If there are any errors you must advise us immediately so we can alter the document. You must not make any alterations directly. If you do we accept no liability for the same.
We will use our best endeavors & resources to do the work in a timely manner upon receipt of all the information from you and the various government departments. However, we give no warranty as to the return of the required searches from the various departments and confirm that the Form 1 will be completed as soon as reasonably possible once all the information is at hand.
If you cancel instructions provided to us as long as the preparation of the Form 1 has not commenced, we will be limited to refunding the fee for services provided but no refund will be provided for any searches or disbursements costs incurred.
By providing us with instructions you are acknowledging that payment must be made for the services and disbursements incurred. Payment is to be made upfront or within thirty (30) days from the Tax Invoice. Any failure to make payment will result in a charge being made over the land and a caveat for unpaid monies lodged over the property for which the request for service is being made.
We are not liable for any loss or damage caused to you under any circumstances in relation to the Form 1 or its use.
By completing the Instruction & Payment Authority, you are indemnifying us from any liability as a result of any claims or use of the Form 1. This includes any errors or omissions in the said Form 1.
We will prepare the Form 1 based on the information provided to us from the Vendor's questionnaire and government searches and if we sign the same for you as agent you are still required to read the document and check it for accuracy and full disclosure as required by law.
The Form 1 is only current at the time of receipt by you as the Vendor, or by the agent. If it is used any time after this you must contact us to confirm if any further updates are required. The statutory searches must be updated with ninety (90) days from the date of ordering or the Form 1 may be obsolete.
The Form 1 cannot be used by any other party other than the vendor or agent selling the property unless you seek our prior written consent.
In these terms, reference to the singular includes the plural and vice versa.
The laws applicable to South Australia apply to all claims arising from the Form 1 which include the Commonwealth Government Privacy Act.
